Step 1: Understanding what you have
The first stage is investigation. The following needs to be assessed:
Existing structural system and retaining walls
Current ceiling height and floor levels
Moisture conditions and waterproofing integrity
Existing access and stair configuration
Existing plumbing systems
Any previous unconsented work
At this stage, the investigation determines whether the basement is:
Feasible to upgrade with moderate works
Feasible but requiring major structural, excavation, and plumbing work
Not practical due to cost, height, or ground conditions
A structural engineer is typically engaged to confirm feasibility and risk. A licensed plumber may also be required to verify existing plumbing services.

A new building consent application (as-built upgrade approach), or
A Certificate of Acceptance (COA) process, if applicable
Step 2: Can your basement become a legal habitable space?
To be approved as habitable, your basement must comply with key New Zealand Building Code requirements, including:
Structural performance
Moisture and damp control
Adequate ventilation and natural light
Stormwater and wastewater drainage
Fire safety and escape routes
Minimum ceiling height (typically 2.4m for habitable spaces)
Insulation and energy efficiency requirements
If the existing space does not meet these requirements, solutions may include lowering floor levels, structural modifications, or redesigning layouts. Unconsented bathrooms or services may also require upgrades to meet current standards.
Step 3: Waterproofing and moisture control
In Auckland conditions, waterproofing is often the defining factor between approval and rejection.

External tanking or membrane systems
Internal membrane and drainage channels
Sump pump and overflow protection
Vapour and moisture barriers
Mechanical ventilation strategy
With a fully engineered moisture control system, building consent can be obtained.
Step 4: Structural and engineering coordination
Basement conversions may require multi-disciplinary input, including:
Structural engineer (retaining walls, slab strengthening, bracing)
Geotechnical engineer (soil and groundwater conditions)
Drainage engineer (stormwater and wastewater management)
These consultants ensure the design meets both safety standards and council expectations.
Step 5: Building consent or Certificate of Acceptance (COA) pathway
Once design documentation is complete, the approval pathway depends on whether the work is proposed or already completed.
Option A — Building Consent (preferred pathway)
If significant works are planned for the basement, a full building consent application is preferred. This involves submitting a building consent, which includes:
Architectural plans (existing and proposed)
Structural engineering design
Waterproofing and drainage details
Fire safety strategy
Producer statements (PS1 and supporting documentation)
Council review typically includes Requests for Information (RFIs), which are common for basement projects due to complexity.
Option B — Certificate of Acceptance (COA) for unconsented work
If basement works have already been completed without consent, a Certificate of Acceptance (COA) may be required.
A COA is issued at Council discretion where it can reasonably assess compliance for the work already carried out.
Key considerations include:
Council inspection of accessible components
Structural and waterproofing verification (where possible)
Supporting engineering reports and documentation
Limitations where concealed work cannot be fully assessed
A COA is not a retrospective building consent, and approval is not guaranteed. In many cases, Council may still require additional investigation, partial opening up of works, or remedial construction before issuing approval.
Step 6: Construction and inspections
Once consent is approved (or COA requirements are defined), construction or remediation must align with approved documentation.
Key inspection stages include:
Pre-line inspection (structure and services)
Waterproofing inspection (critical milestone)
Drainage inspection
Insulation and thermal compliance
Final inspection
All concealed works, especially waterproofing systems, must be signed off before being covered.
Step 7: Final approval — CCC or COA completion
For new consented work, a Code Compliance Certificate (CCC) confirms that the basement is:
Legally compliant
Safe and habitable
Fully approved under the Building Code
For COA pathways, Council issues certification only for the extent of work it can verify. This means the legal status of the space may still be limited compared to a fully consented build.
Without CCC or COA confirmation, a basement cannot be formally recognized as a habitable space.
